These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and Teach Me Space ("Company," "we," "us," or "our"). By accessing or using our website and services, you agree to be bound by these Terms.
If you do not agree to these Terms, please do not use the Service.
2. Description of Service
Teach Me Space is an educational platform providing space science lessons, quizzes, worksheets, and related content. The Service is currently in active development and may be updated, modified, or improved over time.
We strive to provide accurate educational content, but we make no guarantees regarding the completeness, accuracy, or reliability of any information provided.
3. Educational Purpose
All content on Teach Me Space is provided for educational and informational purposes only. The content does not constitute professional, academic, scientific, or technical advice. Users should verify information independently and consult qualified professionals when appropriate.
4. User Accounts
When you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account.
You agree to provide accurate information and to update your information as necessary. We reserve the right to suspend or terminate accounts that violate these Terms.
5. Data and Privacy
Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection and use of data as described therein.
While we implement reasonable security measures, no method of electronic storage or transmission is completely secure. You acknowledge that you provide information at your own risk.
5.1 Data Breach Notification
In compliance with the Pennsylvania Breach of Personal Information Notification Act (73 P.S. ยง 2301 et seq.), if we discover a breach of security involving your personal information, we will:
- Notify affected Pennsylvania residents without unreasonable delay
- Provide notification via email, written notice, or substitute notice as permitted by law
- Include a description of the incident, the types of information involved, and steps you can take to protect yourself
- Notify the Pennsylvania Attorney General if the breach affects more than 1,000 individuals
6. Service Availability
We do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, technical issues, or circumstances beyond our control.
Account data, progress, and stored information may occasionally be affected by system updates or technical issues. We recommend not storing sensitive personal information on the platform.
7. Intellectual Property
All content on Teach Me Space, including but not limited to text, graphics, logos, images, audio, video, software, and educational materials, is the property of Teach Me Space and is protected by copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any content without our prior written consent.
8. Acceptable Use
You agree not to:
- Use automated systems to access the Service without permission
- Attempt to gain unauthorized access to any portion of the Service
- Interfere with or disrupt the Service or servers
- Copy, scrape, or harvest content for redistribution
- Use the Service for any unlawful purpose
- Violate any applicable laws or regulations
9. Payments and Subscriptions
Certain features require a paid subscription. Payment terms, billing cycles, and refund policies are described in our Billing Policy.
9.1 Automatic Renewal Disclosure
In compliance with Pennsylvania and federal automatic renewal laws, we provide the following clear disclosures:
- Recurring Charges: Your subscription will automatically renew at the end of each billing period (monthly) at the then-current rate unless you cancel.
- Current Price: The Pro subscription is $6.00 per month. Prices may change with notice.
- Cancellation: You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period.
- How to Cancel: Log in to your account, go to Profile Settings, and click "Manage Subscription" to cancel through the Stripe billing portal, or contact us through our Contact page.
By purchasing a subscription, you expressly authorize us to charge your payment method on a recurring basis until you cancel. You will receive a confirmation email upon initial purchase and may receive renewal reminders as required by law.
10. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be error-free, secure, or uninterrupted, or that defects will be corrected.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Teach Me Space and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of the Service.
In no event shall our total liability exceed the amount you paid to us in the twelve (12) months preceding the claim. Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.
12. Indemnification
You agree to indemnify, defend, and hold harmless Teach Me Space and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service or violation of these Terms.
13. Children's Privacy (COPPA Compliance)
Teach Me Space is designed for educational use by learners of all ages. We comply with the Children's Online Privacy Protection Act (COPPA) and do not knowingly collect personal information from children under 13 without verifiable parental consent.
If you are under 13 years of age, you may only use this Service with the involvement and consent of a parent or legal guardian. If you are between 13 and 18 years of age, you must have parental or guardian permission to use this Service.
Schools and educational institutions using Teach Me Space are responsible for:
- Obtaining verifiable parental consent for students under 13 years of age
- Complying with COPPA and the Family Educational Rights and Privacy Act (FERPA)
- Providing parents with notice of the school's consent on their behalf
If we discover that we have collected personal information from a child under 13 without proper consent, we will promptly delete that information. Parents may contact us to review, delete, or stop further collection of their child's information.
14. Modifications to Service
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.
15. Dispute Resolution
Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through informal negotiation. You agree to contact us through our Contact page before initiating any formal proceedings.
If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules, except where prohibited by law. Arbitration shall take place in the Commonwealth of Pennsylvania.
To the extent permitted by applicable law, you agree to waive any right to participate in a class action lawsuit or class-wide arbitration. This class action waiver does not apply where prohibited by Pennsylvania law or federal law.
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in a court of competent jurisdiction in Pennsylvania for matters related to intellectual property or unauthorized access to the Service.
16. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law provisions.
You agree to submit to the exclusive jurisdiction of the state and federal courts located in Pennsylvania for the resolution of any disputes not subject to arbitration.
If you are a consumer residing in the European Union, you may also have rights under the laws of your country of residence, and nothing in these Terms affects your statutory rights as a consumer.
17. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the modified Terms.
18. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
19. Consumer Rights (Pennsylvania)
Nothing in these Terms is intended to limit your rights under the Pennsylvania Unfair Trade Practices and Consumer Protection Law (73 P.S. ยง 201-1 et seq.) or other applicable consumer protection laws.
If you are a Pennsylvania resident and believe you have been subject to unfair or deceptive practices, you may file a complaint with the Pennsylvania Office of Attorney General, Bureau of Consumer Protection.
20. Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, and Billing Policy, constitute the entire agreement between you and Teach Me Space regarding the use of the Service.
